No, I didn't send the tenant the statement of condition...and he might be educating himself as I write this...

If I give him back all of his SD and he signs a form saying that he has vacated the premises and has no future claims on the residence, does that mean that after tomorrow (I plan on giving him the SD then), he can't go after me about the escrow thing? I just want to get this guy out of my life and move on...

There is a very good chance that it would work in your favor in case you end up in court so I would go for it. However, DO NOT give him anything until he is out or have given you the keys.

Tell him SIGN + KEYS + OUT = 100% SD all on the same day/time.

It is a learning experience so SCREEN extensively next time.

    Believe you me, I have learned "The Screening Lesson" only too well!

    Thanks for your input...I think I am just going to give him the whole thing back - in the spirit of the holiday! AFTER HE SIGNS THE FORM AND GIVES THE KEYS BACK, OF COURSE!
