I do know in NY the tenant has 3 days to pay the rent from the date of pay or quit notice. I am not sure, but I think you can give the p/q notice the next day if rent is not paid on due date. I think late fees and dates in leases are subjective as long as they are reasonable. Personally, my agreement states that after day 5 a late fee of $10 will be charged...guess mine may be too lenient, but I haven't had any problems yet, KOW. I am in NYS and a sample lease I obtained from the city today stated "a late fee of $20 will be affixed after the 5th day of the month", with rent being due on the 1st.

Your wording seems to imply that if rent is due on the 1st, and not paid by the 2nd, it will be considered late and a fee added on the 3rd.
