We have no lease. Its a month to month written agreement. Law dictates that I must give him 24 hours notice before showing to new prospective clients. Law dictattes that he must give me a copy of key. Law dictates that an injunction must be done.

It will be far easier to call him and negotiate a solution. Maybe give the tenant $200 if you sign a lease before he moves. Forcing the issue will only make the matter worse, and could be much more expensive. Regardless of what is legal.

We have no lease. I'm not going to pay him to leave. I am doing this legaly.

I am sorry to say that it does not help that the law is with you. The tenant has already been given 60 days notice. I do not think an eviction can be accomplished in less.

yeah, I would not show apt while tenant is still living there! Tenant could claim his rolex was stolen while you were showing the apt to potential renter and then sue you for hte replacement cost. bad idea
