You are unclear if this
"resident" is a guest or an accepted tenant who just hasn't signed the lease. Has this person ever paid any rent or security?

Unless this is an uninvited squatter, they have the same rights as a tenant on a month to month rental agreement.

The landlord has the right to terminate with 30 days written notice and so does the tenant.

BTW: How can you let someone in without first having them sign a lease?
