Ask you brother if he wants the permanent (yes, permanent) stamp of an eviction on his credit report. That means he will never be able to rent again, buy a car or whatever else requires even the most mediocre of credit scores. Give him a firm move out date and make it soon. Then file for an eviction if he is not out by that date and not two minutes later.

What would you get if he were evicted and became a homeless man? Would that makes you happier person all the time?
