If you agreed in writing to non-refundable, then yes, it is non-refundable, unless the landlord decides of his/her own volition to return the money to you. It does not matter what your opinion of the state/condition of the home is, if you signed the lease with the house in its current state and willfully moved in. your lease will be honored in a civil suit, as it was a contractual agreement between the two parties. i suggest you review your lease for specific terms, and consider it a lesson learned for the future.
