We had this issue today except there was no eviction the tenants just skipped out. The local Sheriff and Magistrate said it IS civil and will not take any action. Of course we have hundreds of thousands of dollars worth of civil judgements from past tenants out there already and never got anything from that. I asked the Sheriff if they took all the copper and wiring would that still be civil, he said it is their home as long as they are renting it and they can do what they want to the unit as long as they are there anything that breaks the lease would be civil.

Same thing happened, and three sheriff told it is civil matter. I persistently called police several times, and finally one sheriff came. I really did not expect, but he asked whether I would press charge against evicted tenants for stealing. I did.
