If it is "open" and no plea or verdict has occurred, then you are innocent of any charges.

Open felony simply means that you have felony charges pending. In other words the charge has not been dismissed, plead to or been the subject of a jury trial.

Here are some important screening criteria and questions to also consider;

Have you or any other intended occupant, including minors, ever been charged (whether or not resulting in a conviction) or convicted, or pleaded guilty or “no contest” to a felony? Yes_____ No_____

Have you or any other intended occupant, including minors, ever been charged (whether or not resulting in a conviction) or convicted, or pleaded guilty or “no contest” to a misdemeanor involving sexual misconduct or the manufacturing and/or sale of drugs? Yes_____ No_____

Are you or any other intended occupant, including minors, required to register as a Violent or Sex Offender in any jurisdiction? Yes_____ No_____

I'm wondering about the legality of your point. Have you ever been charged??? Something sounds foul about that.

    It's a legal question to ask, especially in Florida where a person can be found guilty of an offense and the court withholds adjudication resulting in no conviction.

I'm with you, my criminal background question is,
"have you ever been arrested for..." Where there's smoke, there's fire. And of course, I'm especially screening for issues with drugs, sex, theft, alcohol & violence. Other criminal matters are a problem, but less so. For instance, I had a tenant with a 7-year old felony charge against him -- for hunting offseason on federal land. (Said he didn't realize he was on federal land, the hunt hadn't started on federal land, etc.) Circs were such that I let that particular felony pass and took him on anyway.

    We always ask if the applicant has ever been charged as in Florida, a person can be found guilty of an offense and the court withholds adjudication.

    Asking about any minors being charged has resulted in uncovering a 11 year old pyromaniac and a 16 year old sexual predator over the years. Since juvenile records are sealed from the public, asking if anyone has ever been 'charged' is one way to uncover such things.
