If you want her out, you must do it LEGALLY by following the LL/T laws of NJ. Read up on them. If the T is MTM, then give her a minimum 30 day notice to be out by May 31. Then follow your eviction laws if she is not out by June 1. It is extremely hard to evict anyone for anything other than non-payment of rent, or being a holdover T after you have terminated the lease. No matter how bad they are tearing up the place, or how bad you want them out for whatever reason, you must do it LEGALLY. They could be in there for months until you, the LL, do everything right. If you don't know NJ LL/T laws, then hire an attorney who does.

thank you for that info. But what I need to know is what is a MTM because unsure what that is and also I just need to know if I can go thru with having to hire attorney and have them send her notice to vacate because the family wants control over property for their own use

    MTM = month to month lease

    Find out what NJ law is on giving notice to end a month to month, if this is what they are on. For example in Florida either party can give 15 days written notice prior to end of the calendar month to terminate M2M lease. No need to hire a lawyer for this notice.

      She is a section 8 tenant that lease is up the 30th of June and I do not want to renew I just want to take control and I did get some advise from a friend that knows someone that knows the law and stated that I could send her a letter by attorney that I would like for her to move out in 30 days because the estate hand been settled and I own property now clear and free and want t to have son move in but then I was also told that the only way I could do that is if I being the owners move into the property but I have lived in my own home over 40 yrs and its my rental property and I feel that now that I own it I should be able to take control without breaking any laws. When the property was in the estate I tried to get her out at the end of her lease but she stated she didn't have money forr security because there is so much damage to property she knows she won't even get it back... is it even worth it to give her all her security to just leave if that is the case?

    I never advise people to seek a lawyer....but you are the exception.

    You clearly have no idea what any NJ laws are about. You have no idea what the Basic concepts are. You need a lawyer before you get into serious trouble with the laws you do not understand.

    Ignorance of the law is no excuse.... Means..get educated or hire someone who is. If you read and cannot understand the landlord/tenant laws....get an attorney.
