This is not a landlord/tenant issue. This belongs in family court.

I think is it nasty for you and your family to take a person your brother obviously care about and try to just dump her on the street...disabled too....geez

Take this to a lawyer...she isn't a tenant and never was....landlord-tenant relationship does not exist..never did.

If the brother really cared out his shack-up, he'd have married her thus vesting her with all marital rights under law. At the very least, if he cared about what happened to her after his death, he should have made a will. The family is treating her pretty much like the decedent treated her.

She absolutely will be treated by a judge as a tenant. In our country we are all about dumping people out on the street every day: veterans, mentally ill, poor, etc.
