This is a 2-part question I was hoping to get some feedback on from more experienced landlords:

PART ONE
I recently sent my tenants a Notice of Lease Non-Renewal via Certified Mail, giving them approximately 72-days notice (in CA, I'm only required to give them 30-days if they've occupied the residence for less than a year, which they have).

I received delivery confirmation from the post office's website (which I believe would stand-up in court as proof of the notice having been delivered) but haven't heard a thing from the tenants. They're not obligated to respond to the Notice, but I'm kind of surprised that they haven't contacted me about it (it's been one week).

Being a bit paranoid and thinking there's a chance they could play dumb and say "We never got a notice..." and start going month-to-month after their lease is up, I'm now wondering if I should follow-up that written notice with an email reminding them about the date they need to have the property vacated by, the move-out conditions, etc. What do you think?

PART TWO
If they never respond to the Notice of Lease Non-Renewal and start going month-to-month on the rent after their lease has officially expired, what should I do? I don't have any experience in this area and am not sure about many things, such as:

- if they continue to pay the rent on time and I cash their checks, does that mean I am legally agreeing to their staying on as month-to-month tenants?

- do I have less ground to stand on should I choose to evict them if they're continuing to pay on-time every month (after the lease has expired) and I am accepting their checks?

BOTTOMLINE
I need them out on time so I can find new tenants for the property and I don't want to assume they're going to be fully cooperative with the process.

If your Notice of Non-renewal didn't include it, I'd definitely send a follow-up letter about 30 days out reminding them that their lease will be ending on X date, and informing them of their right to request a pre-moveout inspection. Include in the letter a checklist of items that have be be done in order for them to receive all of their security deposit back (oven cleaned, baseboards and windowsills wiped down, etc.)

Get this book:
Nolo Press California Rights and Responsibilities book.

You need to give them a written notice of their right to an initial inspection. The notice must include their rights. This notice is included in the above book.

They may waive this right. You can't do the inspection any sooner than 14 days before they move out, but this is your time to give them the option to have an initial (pre-move-out) inspection. I'd also send this with delivery confirmation.

Your delivery confirmation is all you need. No need to get an acknowledgment. If they are not out by the move-out date, you serve them with an eviction notice. Don't accept any more rent.

Get that book.

You know the answer to your own questions. You have your proof of delivery but you want more. You don't get more. Quit making up things to worry about. Part 2 is the same as part 1. You are ending their tenancy. Why would you still accept a rent check, should they send you one?
CA has a book you can get free by going online to Bureau of Real Estate, Tenants and Landlords Guide. Get it. Quit making up things to fret about. Life has enough of that already.
