The state of NC allows 5% late fees tenant has paid late and did not include late fees for last month April rent. I like to know can that late fees be carry over the following month if the rent is pay on time therefore charging additional late fee for the balance of last month?

you cannot charge a late fee for a late fee if that is what you are asking. what does your lease say about late fees?

When you receive May's rent apply it first to the oldest outstanding debt (the late fee for April). Then serve a P/Q for the shortfall in May's rent.
