I have a tenant I call Ms. Wishy-washy. From the start of her tenancy, she has asked on a regular basis if she can do things to or around the property. Most of the things are addressed in the lease which she is referred to when I am asked, but, as you know, every detail to a situation can't be documented or the lease would be as long as the Affordable Care Act.

Her inquiries usually lead to conversations lasting 30 minutes or more as once the question is taken care of, she goes off on other trains of thought. The pisser is that everything she has asked to make changes to she hasn't made one single change. It's like she's playing this game of seeing just what I will agree to.

A couple of times she's even mentioned she will be moving in several months and will give me the proper notice when that time comes. She recently again told me that she would be moving in a couple of months. When I asked her about it later, she said she would have to wait and see what her doctor says in a couple of months. She was recently in a car accident and sustained light injuries to her neck, shoulder and one side. Nothing was broken. I believe she is just using this accident as an excuse not to move because she can't find what she is looking for right now. Meanwhile, if she is going to be gone, I'd rather it be now instead of closer to the end of the year which we know is the worst time for finding tenants.

I'm drafting a letter to her. What I would like to know is how to bring up her wishy-washy behavior being a problem.

I wouldn't do this. If she's month-to-month, just give her proper notice as required by CO, and move her along. You don't need to give her a reason.

I agree with Becky. Keep your letter totally businesslike. State facts only, no opinions. State date to be out, and make a list of items for her to clean before she leaves. If she presses you for a reason for you needing her to move, simply tell her you are going to remodel the place, and you can't do it with someone living there. Do not under any circumstances bring up anything about her injuries.

Your first mistake was to tell her to refer to the lease, instead you should have asked to have the request put in writing and you would review the request for approval or disapproval. No need to get in a long conversation with her. Landlords who write letters to tenants often wind up in court defending it. It's a very bad move on your part to even think of it. Weather she moves or not has nothing to do with her injuries but weather the lease ends and the landlord chooses not to renew. Don't complicate matters by being retaliatory with a letter.

So this all boils down to a tenant who takes up too much of your time, as that is all you complain about. As was posted, have all request be put in writing by the tenant. One thing that's disturbing is that you said " that everything she has asked to make changes to she hasn't made one single change", why are you permitting all these changes to start with? What would you put in a letter that, that the tenant is crazy, mentally off, injured, annoying, time wasting, wishy-washy, etc. Such a letter would come back to bite you in the arse big time, don't be foolish>

Sounds like ADD or ADHD. Don't worry about it as long as she pays.

I think you should set the limit. Tell your tenant what is acceptable and what is not acceptable. I imagine how stressful that situation is.

I learned a trick with tenants, and that is to never talk to them on the phone. And never answer the door unless YOU made an appointment to see them in person.

Do everything by text or email. When she calls, let it go to voicemail, then text or email your response - if it requires one.

Some tenants are just lonely. If you quit giving her attention, and you rearrange how you respond to her airy fairy requests, it won't be that bad. She'll learn that you won't engage, and that the answer will be no, and she'll back off - at least that's been my experience.

So, she'll call and leave really long voicemails that are all over the map. You either ignore it, or you pop off a text - maybe a day later - that says, "Sorry, can't allow you to grow dahlias on the roof."

Don't explain, don't engage. Try that, and you may find you will be okay to keep her.

Sending her a letter to discuss her behavior will just make her year - wow! major drama! Now she REALLY gets your attention.

So, I vote you do not write a letter. Quit answering the phone, only respond by text or email and only if really necessary.

And if by the time her lease ends, and you still just can't stand it, you can let her go. But, the next tenant could be worse LOL! See if you can't get her a little better trained, and you may end up keeping her.
