I am landlord and with the tenant are living in 2 family house, in NJ, with M-M lease after a year lease got expired.

My question, can landlord in such 2 family house ask the tenant to leave without reasons as long as give them a month notice?

Can somebody please confirm?

With a month to month, yes, absolutely.

Just be sure to serve/send your written notice properly & legally & if they do not leave at the end of the 30 days, you may evict for holdover.

There is no legal defense for holdover.

I advise you to have a local attorney ready to start the legal eviction if they are not out after the 30 days expires.

All though there maybe an exception under certain conditions, NJ does require written notice served on the tenant in a certain way. NJ also requires just cause not to renew a lease.

After being a landlord for over a year, you should know your state laws on being a landlord.

Suggest you contact a lawyer to insure you are following state laws.
