With a month to month, yes, absolutely.

Just be sure to serve/send your written notice properly & legally & if they do not leave at the end of the 30 days, you may evict for holdover.

There is no legal defense for holdover.

I advise you to have a local attorney ready to start the legal eviction if they are not out after the 30 days expires.

Here is my next questions. What is the proper & leagal way?

I have already given him the 2 months notice by sending email and text message notice, and asked him move out on 6/4.

would that be proper and legal?

    If you are going to e-mail and text, be sure to follow it up with a letter either handed to him or sent through the mail.

    Text and email may or may not be "legal and proper" in your state. It all depends on what your state's LL/T laws say as to how proper notice between LLs and Ts should be delivered. You should contact an attorney today that knows LL/T laws, to find out if your service is OK. If it's not , you need to do it correctly-----probably by sending a letter out both reg. and certified mail. If you have to do this, a new ending date of June 30 should be put in the letter.

      I agree with G, but even if it is legal - people seem to have much more respect for a written letter and I would always send something like a notice of non-renewal like that.
      I do offer my renewals (asking if the tenant would like to renew by e-mail & discussing when to sign etc. via e-mail, but we have a fairly good relationship.)
