Rent amount different than amount stated in lease - Landlord Forum thread 336799

Rent amount different than amount stated in lease by jeffrey owler (PA) on June 30, 2015 @15:41

So My wife and I are in the process of buying a home. A plan we have had set in place for when our lease ends March of next year. A new couple moved in above are apartment and they are like two elephants, frequently screaming obscenities in the night, and one has even exposed himself to our neighbor. All of this has been reported. Recently the tenants in question confronted my mentally challenged son about reporting them for being to loud and started to humiliate him. Again I went to the office and complained and said if nothing was done, I wanted out of my lease and I would be searching for a home right away. I heard nothing. Friday of last week, we bought a house or at least our offer was accepted. I notified to property manager and in knowing that I would be responsible for an additional $1670 for a "breaking the lease" fee, I looked over the lease. I found that the lease says that an additional charge of $00.00 will be assessed for my garage that I also rent. I know its wrong and I know its stupid but since the property landlord is charging me rent plus the garage every month and the lease says essentially that there is no charge for the garage, is there anything I can do to nullify the lease?

I really think you will end up with far more legal hassle than it will be worth.

Really...landlords and judges are very used to hearing every excuse in the book for why a tenant shouldn't pay the rent..shouldn't be held to the terms of the lease, and every other shouldn't.

You have paid the garage rental fee...therefore you cannot claim your understanding of the garage rental was zero. You past performance will quickly put the lie to that.

There are other remedies in the law for the bad neighbor...especially since he is exposing himself. Like call the police. Report him for commission of this crime. Even...get a restraining order. One of the legal remedies you do not have is to blow off your lease. A judge will ask you...did you get a restraining order. Do you have a copy of your police reports? The answer no will put the lie to how important that was to you.

Just play this straight. We found a place we liked. We brought it. Now we need to have a graceful exit from our lease. Which is pay the exit fee and don't mess with with rest.
