Why have you not contacted the exterminator directly and find out what he has to say ? You need to do this right away. You have a couple of problems. The T should have disposed of his own furniture, but since you returned the full deposit, you are going to have to pay for the removal yourself. Secondly, since you returned the deposit in full, you have admitted total liability for the bedbugs. That means that if the T left you with, say, $2000 worth of furniture, that, in the Ts opinion, had to be destroyed because of YOUR bedbugs, they could sue you to be able to buy new furniture again. To try to protect yourself from that,you need a statement from the exterminator, and maybe have them treat the furniture also. Take pics of EVERYTHING the T left. You may need to store the furniture for 2-3 months in a rented storage place until you get things ironed out. If possible, try to locate your former T and have them sign a letter that says they voluntarily give up all rights to the furniture, and that you will dispose of them at your expense. Hopefully, that letter will be enough to prevent them from suing you.

Thank you for the response! I actually did contact the exterminator today and talked him and got an email from him. When I told him what my tenant said, he said he was greatly exaggerating and the problem was NOWHERE near as serious as my tenant had made it out to be. He also noted he never said there was no way my tenant was completely clear of suspicion and it was entirely possible that he brought them in, though he couldn't be sure. I also had another exterminator do an examination today and he said the same thing.
With this information, I was able to put a stop on the deposit check in time as well. Though I have not been able to reach the tenant yet, though.

I think you did the right thing ... the first time.
Point of origination for bed bugs in a residence like yours where several people live is VERY difficult ... I'd think the onus is on you. I also don't blame the tenant one bit ... one bed bug for me would be one too many ... and I am a landlord who has dealt with infestations (VERY different than a few bed bugs) several times at several locations.

How did you get rid of them, Nicole? Did you use chemicals, heat treatment, or something else? How long did it take, and were your Ts there at the time, or were the places vacant?

California Civil Code section 1950.5(l) provides for statutory damages of up to twice the amount of the security deposit, plus actual damages, court cost and attorney fees if landlord's retention of the security deposit was in bad faith. Stopping payment on a security deposit refund has been determined as an act of bad faith by the courts.
