Well...it is not discrimination. Discrimination is illegal. It is perfectly legal for me to refuse Sect 8 and DSS.

I do not doubt that there are some people on those programs that might be good tenants.....but....I had far too many who were not. The many bad eggs ruined the whole thing for me so that I will not take that risk again. Further, the most desirable tenants will not live near Sect 8 or DSS. I cater to only the top tenants (710+ credit scores). Sect 8 and DSS cannot pass that Requirement.

There are many sections of the city that have Sect 8 and DSS. I know they are not the neighborhood you want to live in. I guess that is even more incentive to work your way off those programs as fast as you can. You sound very intelligent and well spoken, I am sure you will have what it takes to move forward from this point. Good luck.

It is actually an illegal form of discrimination in Oregon. In Oregon we may screen based on income level, but must count section 8 as part of that income. We can't disqualify a tenant just because part of the income is section 8. This went into force last year.

    I know that body of law quite well. Been a landlord in Monroe County (Rochester, NY) for more than 30 years.

      I was not challenging your knowledge of New York law. I was merely commenting that here in Oregon we can't do that and it is illegal. It is a fairly new law and I thought might be of interest. I guess not.

    You can disqualify because their credit score is too low. you can disqualify because your rent is above what they will pay.

    You can disqualify because you will not allow the housing department to do an inspection for sect 8.

      Your first 2 absolutely, as long as it is the same standard applied to everyone. The last one, don't know. The law hasn't been in place long enough to see if landlords will start getting fined for failing to join whichever rent subsidy program and renting to less qualified non subsidized tenants. There is some indication that may happen.
      Right now the rental market is so hot in NW Oregon that we were able to rent a property at about 30% more than it rented for about 1 1/2 years ago in less than 2 weeks, and had many interested inquiries. I'm not too worried, currently, about getting forced into a subsidy program cause I have to lower rents in order not to be over priced for the market.
