So tenancy was terminated with a 30 day notice as of April, 30th. I skipped mediation and went to court 3 times already. Next appearance is scheduled for 9/30, by which it will be the 5th month for holdover. My question is, a NYC judge can give maximum of 6 months to the tenant to move. Is it from the commencement of the case (May in my case) or the date the decision is made (9/30)? The city website doesn't mention it and I found this from two lawyers' websites but they are contradictory. See below: "A Judge has the power to award a Tenant up to six months to stay in the apartment, from the date of the commencement of the proceeding." http://danielgershburg.com/2011/10/04/how-long-does-an-eviction-in-new-york-city-take/ "The Court may then give you an extension, but not beyond six months from the time your case was decided." http://www.mcadamslaw.net/tenantrightsreport.html

But that is only in the case the tenant pays the rent for the extended stay, correct?

best thing to do hire an attorney.
