I've seen stories online, for example: http://www.city-data.com/forum/new-york-city/837826-how-long-does-take-evict-tenant.html in which it took the landlord 8 months to evict a non paying tenant. I don't know if it's any different in a holdover case. In my case, my tenant paid partial for Feb. and stopped paying after that. He became holdover in May, and the 5th court appearance is scheduled for 9/30, which will be his 5th month holding over. He has 3 daughters and a stay home wife, I don't know if that helps him getting more time.

    Why didn't you serve a p/q timely when he stopped paying rent, rather than waiting until his lease expired (which is what holdover means). I suspect that if you had evicted timely for non-payment, you would not be dealing with the court's schedule for delayed possession. Waiting on your part has demonstrated to the court that there's no urgency in your request to gain possession.

      He had no lease. He has been paying late since from last year I took over the house. I did not want to deal with him anymore. So I terminated his month-to-month tenancy.
      If I brought a non-payment, he can always pay me some money and drag it out for years.

      Unfortunately it's summer schedule in Brooklyn T&L court. I was told by the court clerk usually there were 4 trial judges but last time I was there, there was only 1.
