We allowed a person to rent a room in our house for $100 a week. There is no lease. He has only been here 3 weeks but we would like him to leave. He is an odd person and we are just not comfortable with him there. He has refused to leave. Do we need cause to evict him? Is there a certain procedure we need to follow? We live in New Hampshire.

Keep in mind that he may not actually be a tenant. Legally, he may just be a lodger. Probably, he has the rent term--1 week to move. Probably, he can be considered trespassing and the police will remove him, but check your state law on this. It seems that only bits of California and the UK know exactly what to do with lodgers.

You really need to read up on what NH has to say about a lodger in your home. The fact that their rent period is 7 days AND they reside in your primary residence may work to your benefit. In California, someone is considered a tenant when money exchanges hands and they can prove residency, ie receipt of mail. In California, because his rent period is 7 days, all i would have to do is give him a notice of termination of rental agreement, effective in 7 days. After that, he is a holdover, subject to eviction. Typically, the law favors the landlord when the person is in your home. Good luck
