Keep in mind that he may not actually be a tenant. Legally, he may just be a lodger. Probably, he has the rent term--1 week to move. Probably, he can be considered trespassing and the police will remove him, but check your state law on this. It seems that only bits of California and the UK know exactly what to do with lodgers.
