I think John is right--14 days is very fair. Since the girlfriend has asked you how long she can stay, simply tell her 14 days and see what comes of it. I'm not sure you need to be anticipating a legal problem when there may not be one.

It is also time for you to have a discussion with your tenant, the boyfriend. Let him know that he is violating his lease terms by having her live there (she is living there, right? not just coming for visits?). Follow up with a written letter to him. And repeat your offer to him of adding her to the lease after she passes the background check. Tell him that is your policy as stated in the lease. It is a very reasonable offer--explain that you must protect yourself as a landlord. Let him know that you will follow through with whatever lease violation penalties are in your lease, or simply don't renew him.

All this assumes, of course, that she truly is living there. Good luck.
