We decided to move in my friend into our house to help pay for various needs. She officially moved in Sunday, May 3, 2015. She brought her 2 dogs with her. She's living in a bedroom and has access to all other rooms, including bathroom, kitchen, and living rooms. ALL utilities are included. She doesn't have to pay for gas, water, electricity, TV, internet, garbage, even toilet paper. She has access to a dishwasher, refrigerator, washer and dryer, including detergents, etc. She does pay for her own food, toiletries, dog food, and other furnishings she's moved into the bedroom. She's also allowed to park in our driveway. The house and bedroom she resides in has been furnished even before she moved in. She's been paying $500 each month on time. We never made her pay a deposit.

I've determined her to be very unsanitary. I'm always doing her dishes and cleaning up after her. She also keeps her TV running in her room all night, as well as a fan. I've discovered one of her dogs to not be potty trained either.

It's about to be September and we decided to make a rent increase to $700 due to lack of income and research of other nearby rentals. She asked for 3 months for it to take effect in which we agreed, although I understand I only need to allow 60 days.

With her rent money we've already done many upgrades to the house. We remodeled our bathroom and got a new deck in the backyard. The house is outdated and still looks like the 1970's. In order to increase property value to sell reasonably in the future, many more projects need to be completed, including a new roof.

I'm working on creating the rental agreement and I'm not sure how much to include. Is it too late to ask for a deposit? How much of this detail should I state in the rental agreement? Is $700 fair for everything she gets? Any other advice PLEASE! It would be GREATLY appreciated. Thank you!

You have made every mistake a landlord that could possibly be made. Your situation can only get worse. Move this tenant out and get another. Right Now. You can tell your tenant that renting harder than you thought it would be. Do not expect your tenant to be happy. But you have to get behind this thing and push. It may take a lawyer to help you. An increased rent will not make things better.

I think your T has already decided what she is going to do-----move out. You already discussed the new details with her, and that's why she asked you to delay the start of it-----so she has time to find a new place before your new lease takes effect. You are asking a 40% increase in rent, plus you want her to pay a deposit of either $500 or $700. To her, that seems totally unfair, for the same living arrangements she is getting now. Just give her and her 2 dogs notice to move in 60 days, find some new Ts, and start over again.
