SD served them with the judgement and 5-day lockout notice. The lockout notice told them the SD would be there at 0601 Thursday.

The SD, locksmith and I were there at 0945 this morning.

Frances the daughter went storming up with her paperwork and told us that since she was not named in the suit that was a direct order for her to stay in the house.

Unfortunately, both the judgement and writ stated specifically that all occupants, tenants, sub leaders,any individuals and all other persons were to leave. The time to object was when the original unlawful detainer was served to X and Does 1-10.

Then she changed her story and said she needed more time. The sheriff told her she had 15 minutes.

The house is worse for the wear of 15 years but not bad. They took the fridge and stove but left a dog, car and a boat---animal control took the dog at straight up noon; the car and boat were towed. Rekeyed the locks AND took loads of photos. Document junk left behind and video's the rest of the house to prove they left NOTHING.

Monday, the lot cleanup guys will get rid of all the junk in the yard. They'll tear of the non-permitted wooden porch while they are at it.

Not as terrible as it could have been.

Thank you for all your support and help. Next tenant, I'm going to be a little more adamant about paperwork!

    Kathleen, youre almost done. Read very carefully the California civil codes that cover what to do with a tenants belongings left behind at the end of a tenancy. It would be a shame to screw things up now that youre so close to closing this particular chapter.

    Also, if the appliances did not belong to them, add them to your list of security deposit deductions (make sure you mail it within 21 days to their last known address). Tread carefully and you should be ok and be prepared to file in small claims court. It will dog them for years to come..
