it is unlawful for a landlord to discriminate against any person because of the person's familial status.

Can you ask who will be living in your rental house?

Yes, it is unlawful. Yes, you can ask--not for the purposes of discrimination, but for the purposes of having an accurate record of who will be residing at the property.

You can ask the name and the relationship. Then you can ask for their FICO score. If it is less than 675 say goodbye.

Ask for SS# and photocopies of DL.
If you find a more qualified applicant, MAKE SURE that you use a FICO score as your qualifier.

If you are asking a prospective applicant, you cannot ask the following questions;

How many children or what are their ages, nor may a landlord ask if they are expecting or planning to have children.

You may ask how many occupants will being living in the rental property and require those 18 and over to each fill out a separate application.
