If you are asking a prospective applicant, you cannot ask the following questions;

How many children or what are their ages, nor may a landlord ask if they are expecting or planning to have children.

You may ask how many occupants will being living in the rental property and require those 18 and over to each fill out a separate application.

How about if they put kid's name on the lease agreement?
