This does not make sense? You say the tenant is trying to get out of the lease but wants new carpet? Painting is a security deposit issue, just deduct the cost of repainting from the security deposit when tenant vacates.

Was the carpet cleaned prior to tenant moving in, if so, the tenant should be responsible for any cleaning during the lease. Have you inspected the carpet yourself to see why the tenant thinks it needs to be replaced?

Why is the tenant trying to get out of lease? Did you screen this tenant completely before acceptance? Do you have a deposit?

If this is a typical S8 tenant, there won't be enough SD to cover all the damages she leaves behind. I would require she pay additional deposit money NOW to cover the cost of repainting back to the original color when she leaves. DO NOT bother to repaint now, she will likely alter it again.

    The landlord could require a security deposit equal to two months rent. Asking for additional security deposit now would be a change in the terms of the lease and maybe violate fair housing rules.

    Sounds as if the landlord failed to do a proper background check if after one month, the tenant is a problem.

    Still, why would a tenant looking to move out after one month, want new carpet?

      As an alternative to an additional security deposit, LL could charge tenant for the actual damage now, rather than wait until the tenant leaves. Holding a SD against prospective damage is very different than asking for current payment for actual damage.

      Tenant has been there since 2009. Not a month. I have security deposit. She's just all the sudden wants out of the lease and is trying to make up any problems to get out. The lease just renewed in September.
