Painter - Landlord Forum thread 341136

Tenant hired a painter to paint upstairs bedrooms, and did not pay for the work or the materials. This was all done without my knowing, as the tenant informed the painter they owned the home. Tenant has now moved out, and the painter is suing me for the cost. Am I responsible for this?

No. Unfortunately, the painter got scammed by your former T. Even though it was your home that got "enhanced" (and from your viewpoint, that would be a no.), you never had any contact with the painter, and no oral or written contract with him, nor did you give the T your permission to have it painted. The painter did not do his "due diligence" and checked out the person or the house. Now, if the painter did a real good job, you like the colors, and it still looks as though as it will last another 5 years before it needs painting again, then you could offer the painter that you will pay him 10%-25% of what he is asking, to settle out of court. Otherwise, you will both take your chances in front of a judge.

Counter sue the painter for the cost of returning the the painted surface to its original color. Your counter suit should be equal to his bill.

don't know if the painter can "sue" you but depending on the timing, they may be able to file a mechanics lien... which basically is a law suit.
