T brought the items to my attention 7 weeks after they moved in. Since they are necessary for safety reasons, I believe they would qualify under section 2. of CA Civil code 1954. There are some other minor repairs that I don't object to and if we were on communicating terms, I wouldn't mind coming and fixing them myself under section D.3. T have been rude to prior contractors who don't ever want to do work again as long as they live there, and when I attempt to talk to them, they behave in a hostile, hysterical and threatening manner. When I resort to mailing letters and point out the law to them, they make sarcastic remarks that I pride myself as being a LL who provides a personal touch so why all the legalese stuff.

First, quit citing "codes" to tenants. Even though all LLs should know their own state codes, most tenants don't know and don't care about them. They probably regard you as "uppity" , and are holding your title of "landlord" way above their heads. Using "Legalese" is simply not a good way to communicate with tenants. It frustrates them to no end. How would you like it if your family doctor talked to you, using all those big, long, medical words that only doctors understand? Just write them a normal, easy-to-understand letter asking them to give you several dates and times as to when you can have your contractor come there to get the items done. Then stick to whatever the T says. So far, what you have mentioned, does not seem to me that they are emergency items that need to get done as soon as possible. Save all communications with them (emails and texts) , so if any problems arise, you have proof as to what was said.

    That seems very contrary to what Nolo recommends and other advise I've read in this forum. It is not my first choice to do business this way. I have had no issues with my other tenants in other units and the two prior tenants in their unit. I actually stay away from Nolo Leases because I feel they cite a few too many civil codes, but now I'm dealing with a manipulative T who has a high sense of entitlement and tries to make up rules on the fly that are contrary to CA law. I've received advise to cease texting and emailing and she only wants me to communicate via email.

So your tenants brought this to your attention back in mid September and you are now getting to them here at the end of November because they are deemed safety issues? I can see why the tenants are upset, waiting 7-8 weeks for the repairs and you decide to have them done during the thanksgiving holiday. So, this is what you call providing a personal touch? Why were these safety repairs not made before the tenants moved in? You are definitely not going about these the right way are you? Your way has resulted in safety repairs not done and tenants who are pissed off at you. I would rethink my tactics and try to amend your relationship with your tenants, July is a long way off.

    They are here in the US for part of the year, so lease is not a 12 month lease. There was also an approval process with the HOA because of exterior lights. My question is really about the 24 hour right to enter with or without them at home. I don't especially want to be there without them there, but they want to call the shots as to the timing. I'm merely trying to coordinate a time that works for all three of us. The contractor said he's available Monday, but maybe I should ask if he's availableTuesday to allow T time to "come back" from the three day holiday even though tecnically Friday wasn't a holiday. T didn't want to be bothered before Thanksgiving.

Ill just toss in my two cents. Since it is a safety issue and tenant driven, i would NOTIFY them that i will be there - END OF STORY. They can be there if they wish, but after posting the notice, your legal obligation is fulfilled.
