NY and NJ have determined through the courts that the landlord is responsible in multi unit buildings.

I have a lengthy bed bug addendum and bed bug agreement the each tenant must sign as part of the lease. It basically will scare the it out of anyone..and they will move heaven and earth to do everything to avoid risky behavior

Over these last 5 years or so, It has been very effective to avoiding the problem (so far)

In general I think the landlord is always responsible (especially in a multi-unit building) unless it can be proven that the tenant is responsible (and that is often very hard)

Either way though basically if you are smart you will set your policies to encourage your tenant to report the bedbugs to you ASAP and then YOU will pay to have them removed (Assuming the tenant isn't doing crazy things like bringing them in on purpose).

Making the tenants pay or punishing them for reporting the bedbugs is 100% foolish and will be counter-productive in the long run. The longer it continues the worse the infestation gets. It can get to the point where you will spend many thousands and the tenant can just move out with you being able to do little if nothing to the tenant. You probably won't even be able to legally take their security deposit.

Be smart. Don't try to screw over your tenants and make them responsible even when they probably aren't.

Let me add that if I were a current landlord of a multi-unit building I would actually reward tenants who reported a bed bug infestation to me. I might even offer $20 gift certificates to a local restaurant or such and tell each tenant this at move-in. Do some research about how they spread and multiply and then think about this one some. No one will intentionally put them in their own unit on purpose if they plan on living there so you don't have to worry about that! No one wants bedbugs.

Also tenant education is very very wise. If you have the time actually sit down with them for ten minutes and educate them. That means actually educate them and not just threaten them and tell them all the things they cannot do which are "lease violations".
