You should check your state's statues for what happens to a rental contract if the tenant dies. For instance, in Wisconsin, the date the person passes essentially acts as a 30 day notice to the landlord (we actually had this happen last month).

Unless someone in the familiy is on the lease, you do not need to allow them to stay...however, considering the situation, you may want to meet with them and discuss the apartment. If someone wishes to stay, you should make it clear that they will need to qualify and they would need to sign a lease. If they decide otherwise, you may want to allow them to pay an additional month of rent if their Auntie passed close to the end of the month.

Do not forget that it is YOUR property. Whatever they do, it must agree with you. you can be empathetic withe them while protecting your position.
