Harassment - Landlord Forum thread 345157

Harassment by Anonymous (N. Carolina) on May 24, 2016 @06:06

A friend has trouble with an ex-tenant

Seems the tenant caused a lot of damage and didn't pay the last month rent. Got evicted.

Landlord had to sue for the damages. But she then didn't show up for the court appearance. It was dismissed, of course. The landlord then refilled the same case, and didn't show up again. It was again dismissed. (Yeah I know not very smart. She said it was because her medical condition kept her from getting up on time)

So a couple years pass, and she hires a lawyer to try to go after them for this money. So, now the ex-tenant files claiming harassment.

I do not know. I can seen the tenants point of view. But, they did cause thousands in damage. Yeah, but it was dismissed. Twice

What is the opinion here?

I think if either case was dismissed "with prejudice" that means you cannot bring the case back again. If that was the case...then, yeah, the landlord is harassing them

If however, the case was dismissed without prejudice, the case can be refilled as long as she is still within the statue of limitations. And, the ex-tenant has no case against her for doing so

yeah,........right,.......if indeed you're not a troll, your '''friend''' needs to either hire a lawyer to have appeared for them in the first place,.or buy two alarm clocks (system redundancy) of sell the property(ies) and become a mattress tester.
