Landlord received a written 30 day notice from tenant and a request for a pre move out inspection. Landlord contacted the property manager who moved in the family to inquire how to handle request. The realtor/property manager said it was optional, but advised against it. She stated that if damage occurred after the inspection, it might be harder to deduct those charges. She concluded by saying that if landlord wanted to do it as a courtesy, it was optional but not required.
Landlord followed advice and did not complete a pre move out inspection with tenant present.
After completing a post move out inspection and sending a detailed summary of deductions for cleaning and damages, landlord was informed that the pre move out inspection with tenant present was required. The property was professionally cleaned and repairs made shortly after move out.
What options does the landlord have?
Landlord wants to work in good faith with ex tenants, but a lot if money was invested in post move out repairs and clean up. Advice/feedback please?

Options for the landlord??
Landlord should know the law.
Landlord needs to educate him/herself about the law. There are books about land lording specific to California.

Fire the realtor/property manager, as they obviously don't know the law.

If the landlord has photos of before and after, that might help in court, but the BIG DEAL is that the LL did not do a pre-move out inspection, so the point of having photos may be moot.

I agree with Just Me - failing to knowing CA ll/tenant falls squarely on the shoulders of the property manager and failing to know this critical statute could cost YOU, the owner, big time. The law that pertains to move out inspections states no sooner than 14 days of tenant vacating, the ll MUST OFFER the tenant the option of a move out inspection. Your tenant requested one, and you received crappy advise to refuse it. The inspection is only optional if the tenant does NOT want it AFTER it being offered. Photos taken during the inspection will point out if damage was AFTER the inspection and has no bearing whatsoever on whether or not you can deduct. LEARN THE LAW!!

Many CA landlords are not familiar with the state specific pre-move-out inspection option that the tenants have.

I am curious. What relationship do you have to this situation? You do not refer to yourself as the landlord, the property manager, or an investor.

Sue the Broker in charge of the prop mgmt. company. He is responsible to know/follow the law on doing pre-move-out insp. You have a strong case for small claims from the broker is what you say is true
