Couple living together (both on lease)- broke up - moved at end of lease. Couple cannot agree on deposit split and landlord will only disperse funds as agreed to by tenants. What happens to the funds if they cannot reach an agreement on split. Thanks!

Advice from LPA Attorney Reno says make check out in both their names.

Let them worry about how they split it.
Not your problem.

Make sure when you make out the check to BOTH their names, you include the word AND between their names, not OR.

Unless it is required by a government body, that is not the way for a landlord to handle Security Deposits...and this is the exact reason why.

As they replies above say, write one check with all the tenant names. There is no need for the landlord to get involved with the allocation of those funds.

Geez, no. Do not make it out to cash.

Unless you are renting rooms, the tenants are responsible for the contents fo the lease jointly. The security deposit is then paid jointly, so the landlord should return the security deposit jointly.
