I would never discuss the items in the report directly with the tenant. I make a conscious decision, yes or no, and then leave it up to the tenant to rebut anything in the report they feel is incorrect. If it isn't rebutted, that means it should be there and you made an informed decision.

I leave a position on the application, extra space, for tenants to describe why their financial/credit position is the way it is. If they chose not to be informative and forthcoming with the information, I am not going to waste my time to inquire and possibly get into an issue with disclosing information on the credit report.

I don't either, I just make a decision about what's on the report myself, and the other parts of their application.

And if they contact me to ask about the status of the their application, and I've decided to decline, I just tell them they will be receiving the FCRA letter from me and they can request a copy of their credit report from the agency. I've rarely had anyone argue over that--they already know that they have bad credit so it's no surprise to them.
