I've had a new tenant in for 6 months. He's been late 4 out of the 6 months. I do my robo-landlord thing and send out my friendly form letter when he's 3 days late, then the more serious Pay or Quit letter when the rent doesn't arrive within 5 days and finally, the "if the rent is not in my mail box by tomorrow morning i'm filing eviction proceedings" letter. He aways pays by this date which is usually the 10th. I"m really sick of chasing after him. I know it's a choice between getting rid of him and going empty until I have a new tenant or putting up with this. OR... is there another tact I can take? I do things by the book...

Is there a late fee in your lease? And if so are you enforcing it?

And, you could start posting the p/q notice immediately when he's overdue.

Do you have it in your lease that you can charge him late charges when he is late? If you do, are you charging them each month? Late charges do 2 things. They "try" to prevent the T from being late by assessing extra amounts for being late. Sometimes it works, sometimes it doesn't. The other thing late charges do, is compensate the LL for their extra time, and costs of notification letters. As long as you GET the late fees, and the T does not go past the 15th of the month, just keep the T till the end of the lease, and then either raise the rent by $50-$100/ month, or simply tell the T to move. Besides, you will have about a 5% chance of a judge granting you an eviction bases on late rent payments, ESPECIALLY if you are getting compensated for those late payments.
