Is there a late fee in your lease? And if so are you enforcing it?
And, you could start posting the p/q notice immediately when he's overdue.

Yes, I have a $3 a day late fee as that is all the local courts will enforce. I give the friendly "you're late" letter after 3 days and the PorQ after 5. I don't do this if a tenant calls me before the rent is due and asks if it's ok to be a few days late. I don't even charge late fees when they let me know they're going to be late. But when a T avoids me, I start trying to contact them and that's what makes me irritated.

Does your state LL/T laws address the amount of late fees you can charge? $3 seems awfully low in this day and age. Other than yours, I have never heard of any late fees around the country being less than $10/day. Many seem to be $15-$25, usually with a cap of $100/month. You should check it out with an attorney who knows LL/T laws.

Judges will throw out late fees that are deemed to be excessive or punitive. Late fees are to cover the landlord's cost of a late payment, they are not meant to be punitive.
Daily fees are punitive and are often not held up in court.
