For now, do nothing. If their rent is paid for July, you need to wait til they do not pay you any rent for Aug. Then start eviction procedures for your state, on or about the 7th of Aug. I say Aug 7 because if you have accepted a pattern of allowing them to be 1 week late, then you need to wait that 1 week to see if they pay the rent. DO NOT try to force your way in to show the property. You gave them the option to buy your property, and they declined. Just LET them move out, while you file for eviction. Above all, DO NOT say anything to the mortgage comp. You could get yourself in BIG trouble if they file a lawsuit against you. You cannot call the credit agencies either. The BEST thing you can do, is cool your heels, and wait till they are totally out, then fix your place up, before you show it to anybody. If you try to harass them in any way, they could leave your place trashed when the leave. A LL should never try to sell a single family home while a tenant is still there. If you want to sell it now, vacate it, fix it up, and keep it vacant til you either sell it, of take it off the for sale market, and rent it out again, till next spring. Then vacate it in the spring, and try to sell it over next summer.

I agree with G. There are some mean, vindictive people out there and your current T may just trash the place. Calm down, let them move out, take your loss and move on. I am always tempted to engage tenants like this but I've learned my lesson and I let it go.

I failed to mention, I think, I already have new tenants who eventually want to buy the place...we know them!

No, they didn't pay for July, and now we are nearly into August.

So here we sit waiting for them to leave and they haven't paid us anything...and we have people willing and eager to move in yesterday.

    So, where, exactly, is the tenants incentive to move out? They didn't pay you rent for July, and you did nothing. Are you going to continue to do nothing, and see if they are still there on Aug 15? What are you going to do on Aug 16, if they are still there? And your new Ts-----they are not going to wait around forever for you to remove the current Ts. At this point, WHILE you are "waiting", contact an attorney, tell him your story, and do what he says, or you may be "waiting" for Xmas to come, to see if your Ts will move then, or not.

    When things go south near the end of the tenancy and I face problem Ts I just tell them If they leave the place reasonably neat and get out in 5 days I'll give them their security deposit back when they give me the keys. It has worked the 3 times I've decided to use it. It makes things happen fast and keeps you out of court.

Didn't these tenants ask you to apply the security deposit to July's rent? They will be out by the 15th of the month?

Hopefully, you took pictures and/or video before they moved in. Then once they vacate...take pictures and video. Take extra pictures of any damages. Keep your receipts for the clean-up and repairs. Then take them to court for damages, and additional rent due.

I had one tenant remove the wall phone out my rental house. They replaced it with a red phone. I met them at the driveway....Asked for the phone back. They had the red phone sitting right next to him in the car.

Another tenant...her mother was a antique freak. This home had a claw foot bathtub in it. When the tenant moved out. They took the claw foot bathtub too!
