What do your state laws say regarding security deposits? According to a quick search, it appears as though the landlord is required to return the tenant's security deposit within 30 days after move-out.

Remember, the security deposit is the property of the tenant, and state law allows the landlord to make certain deductions after move-out.

You would be wise to handle the security deposit properly.

he violated lease by having an unauthorized person living in the home. can i keep security deposit for that reason?

    I agree, the answer is no. If you had identified a lease violation during the course of the lease agreement you could have issued a lease violation notice and pursued requiring the tenant to cure the violation or face lease violation fees. At this point in time, there is no lease violation because they are out, so I think you're out of luck.

    I am sure I could come up with some creative ideas of how to make an argument that you incurred costs above and beyond what the lease agreement states for the added occupant, but I also don't think any judge would even listen.
