If your lease stated that they would be charged if they failed to maintain lawn, I think you are owed the money but since this all occurred before the end of their lease it may be legally safer to send them a bill them for the weed removal and then later deduct from the deposit if they failed to pay the bill (keeping in mind state law about the time period for the SD). Also it would be good if you have some photos as proof too.

Thanks for that advice. That's where I'm uncertain of how solid my footing is. There's no language in the lease that specifically says they can be charged if they fail to maintain the lawn/landscaping...it just says they have to keep it maintained. In another article it says they have to maintain the property/premises in the same condition in which they found it upon the start of their lease (which is definitely not the case as I have before/now photos). I guess that's what I'm hanging my hat on. But I have to admit that the tenant gave me pause when they basically said I screwed up by scheduling the landscaping cleanup before the end of their lease. That may very well be my screwup, but I also didn't feel like I could wait until the exact end of their lease to see if they were going to clean it up properly (and risk losing more potential tenants because the place looked awful).

    You can't bill them then. You can threaten to kick them out if they don't comply.

      It seems to me you could build something into your lease about posting the c/q notice for overgrown lawn and billing the tenant if they don't get the problem fixed in the c/q time frame. But the timing of the way OP did things isn't helping in this case.

      The larger problem here is who is managing this property if the owner lives across the country. It sounds like there is no PM and no one is stopping by to see what is going on there. Not a good situation.
