    Not trying to be rude. It's a legitimate question. I'm wondering why the lease is between her and the restaurant owner instead of her and the people actually living in the unit.

    I'm not even going to ask why a 5 bedroom apartment is only $985/month.

      I agree with you, J. It was a legitimate question about possible illegals. And, yes, 5 bedrooms times $200 per month is $1,000. And 2 people per bedroom is only $100 / month / person. Where in this country can a single person rent a single room for $100/month ? That's only $3.33 per day. And if they ARE illegal, and the LL KNOWS they are illegal, she can be held accountable for housing illegals, by the Fed. gov't. I think Tati needs to terminate the lease with the restaurant owner before she gets in trouble.

I never thought about illegal aliens .
Who knows ? maybe you are right.

All of them are picked up daily at the rental property in the morning and come back to sleep at night time when the restaurant close.
The Restaurant Van which belong to the Chinese couple and other cars commute employee daily.

The couple pay the rent on time. The main problem is the month to month rental agreement states 9 occupants in a 5Br apt $975 then month later tax increased and I requested $985 and that is what they are paying for 11 occupants.
Now I noticed two more occupants were added without my authorization. I need to stop this. Nevertheless ,I need the income and I believe I should ask for more money since excessive wear and tear maybe an issue.

What do you think?

    I think wear and tear is going to be an issue even with just 9 people in there.

    You would almost have to go in there and do a head count nightly to keep tabs on how many are there. If they are being picked up in a van I assume they don't have cars, so you can't look for unauthorized cars.

    Your best bet is to communicate with the restaurant owner that you don't want these extras living there. Although...it sounds like you don't know the names of the people living in there. At 11 people in a 5 bedroom they are still technically within the HUD guidelines. I don't know whether legally you can limit them to 9 occupants if you don't have nine named individuals on the lease.

    Check your local town/county laws to make sure there is not a max number of people allowed for this type of unit. You don't want the code people after you.

    If the restaurant owner is paying the rent on time and all you care about is wear and tear, it may be better to forget about the number of occupants and just do periodic inspections (maybe every month or two) to look for damage and unsanitary conditions. And if you see that, give notice to end their month to month lease.
