I am a brand new landlord and I am experiencing an odd issue. My tenant has five wax potpourri warmers running twenty-four hours a day in the 1500 sq ft apartment. She also has dryer sheets in all the heat registers. I have asked if there is a bad smell in the apartment that she is trying to cover up and she said no. The fragrance is sinking into the floor and in the walls. This tenant has two dogs and is a smoker. I do not allow smoking inside the unit and I have never seen evidence of smoking inside. Her lease expires in a month and I want to write something in it putting a limit on air fresheners. The other tenant underneath her also had excessive air fresheners but they were the plug in style. The smell was sickening. I had to repaint and it took a month to air out the place after he moved out. Anybody else having any trouble with air fresheners?

You don't have a problem with the air fresheners, you have a MAJOR problem with the tenant. No matter what you put in your lease, the T is not going to abide by it. You said the T was a smoker. Do you really, truly, believe she does not smoke in the apartment?? That's what all the air fresheners and dryer sheets are for----to cover it up. Her lease is up shortly. DO NOT RENEW IT. Her dogs may be pooping and peeing on the floor, also. The other T has air frs. because the smell is coming thru the vents or the ceilings in that apartment. If you don't get rid of the upper T, you are going to lose the lower T, also. NEVER allow pets or smokers in your apartment, as you can see it has affected the other T., and is creating lots of damage. Give her notice now, to be out by Oct 31., no matter WHAT it costs you. Right now, between the dogs, her smoking, and the air frs, you could easily have several thousand $ of damage that you are going to remedy. Hopefully, you got a LARGE deposit from that person----you're gonna need it.

Not to be rude but it sounds like you might be OCD or have some other mental condition. There is a chance that maybe one tenant has some kind of problem and is going nuts with the air fresheners but then you state that the tenant under her also has too many air fresheners. It seems to me then that it is far more likely that it is you who is more the problem rather than two tenants with the same issue living right next to one another.

It sounds to me as if you might be highly prone to prying into your tenant's personal living arrangements and that you might be prone to micro-managing them. If so this is a mistake as more than likely a court would see this as a violation of the tenant's quiet enjoyment and possible harassment. If this is what is going on and you find it hard to keep yourself in check I would encourage you to either hire a property manager or at the very least discuss this with a mental health professional.
