You don't have a problem with the air fresheners, you have a MAJOR problem with the tenant. No matter what you put in your lease, the T is not going to abide by it. You said the T was a smoker. Do you really, truly, believe she does not smoke in the apartment?? That's what all the air fresheners and dryer sheets are for----to cover it up. Her lease is up shortly. DO NOT RENEW IT. Her dogs may be pooping and peeing on the floor, also. The other T has air frs. because the smell is coming thru the vents or the ceilings in that apartment. If you don't get rid of the upper T, you are going to lose the lower T, also. NEVER allow pets or smokers in your apartment, as you can see it has affected the other T., and is creating lots of damage. Give her notice now, to be out by Oct 31., no matter WHAT it costs you. Right now, between the dogs, her smoking, and the air frs, you could easily have several thousand $ of damage that you are going to remedy. Hopefully, you got a LARGE deposit from that person----you're gonna need it.
