By your post, I take it the T has not paid you for Aug. rent, either. I was just wondering how many more months of rent are you willing to lose before you decide to LEGALLY get him out. He is playing you for a "patsy." Unless you still want him in there, paying you no rent til Xmas, you need to follow the SC LL/T laws on nonpayment of rent, and the eviction laws, and get rid of him ASAP. The ending of a lease has absolutely nothing to do with the nonpayment of rent. Start the eviction process NOW, for nonpayment of rent. DO NOT RENEW his lease under any circumstances. Remember, rent is an on-going thing, and " waiting on a settlement of some sort" should never be used as an excuse to delay a rent payment. Besides, you can always accept the rent in smaller amounts, rather than wait for the full amount at a future date. He simply is "stringing you along", til you force him out thru legal means.

On the morning of the fourth day, file a UD and have it served.

I really recommend a law firm---they take care of every thing---serving, filing, fiddly bits between thr UD and court. Just get all of your paperwork together.

I keep a plastic closing clipboard and keep copies of everything and store them on a Target plastic box

All correspondence,rental agreements,addendums, original application, texts and type to text voice mails and photos taken at the walk through. I take photo of drivers license, SS card pay stubs, EVERYTHING. I keep all repair requests and invoices. It sounds like a lot but it all fits.

Once the lawyers are involved. I don't engage. If the T needs repairs, I call my handyman and he makes arrangements to do the repair.

Be advised that the sooner you do this (like today, following your state's legalities), the less likely then tenant will call the health department or housing authority

I learned this all st the Ivy League school of Hard Knocks.It's an expensive education bit it's only a one time course.

My first once was a likable guy who was always short with a mouthful of promises. That one cost me $14k. Now I use the LPA m2m agreement and addendums. I read every line and we both sign each article.

I still manage to have one apple go bad and slip thru every year or so. It is usually because they've lost their jobs or started an illegal grow or kitchen.
