You are correct, anon. It was my opinion I gave, and it is an open forum for anyone, including you, to give their opinions as they see them. Thank you for yours, and I respect it. The idea of anyone having a 50/50 chance of winning, applies to anyone going to court, for any reason, anywhere in this country, including courts of appeals, and the U.S. Supreme Court. What is said or presented as evidence in front of a judge, by both parties, determines who "wins" or who "loses". In this case, the LL has so far, "won" unless the LL gives the T back his full deposit, or the T takes him to court, where BOTH must present their evidence, and hope that they win. Then it simply becomes who has the best evidence, and who has followed the laws, and who hasn't. And even if the LL loses BIGTIME, he still learned something from it. As for my posts, please contact the forum owners about them. They are the ones who have the final say about anything posted on their forum. G.

G, I have to disagree with you on this one. Based on the information provided by the original poster, it is poor advice.

California law has specific requirements about security deposits and providing receipts, invoices, and estimates. If this goes to court, the only way the landlord will win is if the tenant decides to settle in some way due to feeling guilty or the judge decides to ignore the law. That will not result in a 50/50 possibility of winning...more like 1/99.

It would have been better to suggest that he learn more about his state statutes or have him contact legel help.

Gary, while your opinion is often fairly good. This landlord was asking about the LAW. Really, your opinion in this matter was factual misleading,

If you came here hoping to get the actual facts from this forum..I think you would be upset if someone was dropping g factual incorrect information on you.

I try to stick to the facts. When I do not know, I simply don't reply.

Opinions are great...but only with the op is asking for an opinion...not the facts.
