A "holdover" T is not the same as not paying rent, and they "held over" past the 3 days. So, did you give them a "termination of lease" letter, or a 3 day notice to pay rent, or quit? If the T is still there past the date on the termination of lease letter, then they are considered a "holdover" T in legal terms. If they are still there past the 3 days, they simply chose to not pay the rent, or move, and now you must file thru your court system to evict them. So, in your mind, they "held over" but you may have to give them a different kind of a notice now, just depending of what type of "notice" you gave. Google your state's eviction laws for more info.

no i was gonna start on november they havent paid rent and refuse to and they have no lease

    This is all the more reason you need to Google NY LL/T laws. If you don't follow your laws exactly, about evicting a tenant, the T could stay there for several months, paying you no rent, until you can LEGALLY get them out thru the court system. You may even need to contact an attorney to help you evict them. Don't wait. Do it tomorrow. The longer you wait to evict someone, the more money you will lose. And usually if there is no lease to be found, most states LL/T laws cover the basic lease agreements. So find those laws, get an attorney, or do both. But do it asap.
