Judgement against tenant with CoSigner - Landlord Forum thread 348803

Judgement against tenant with CoSigner by Paul (New York State) on October 17, 2016 @08:39

Received a judgement from court against the tenant. The co signer lives about 100 miles away in another state. How to handle this?

Does you lease say...
Tenants ---names----

JOINTLY and SEVERALBLY

??

If it does, you can go after either one for the total amount.

If it doesn't then you will have to get a judgement against both, as either can duck because you didn't allow to sever their names and hence their cases. Then figure out how to pursue both for the total.

Usually leases use that "SEVERALBLY" clause for this reason
