I didn't answer because I'm not really sure. I'd lean toward the OP can proceed. Even though the magistrate's office won't give out legal advice, they probably will answer this one since they make the determination what to do if the tenant claims partial payment.

all that said, I've got a many year relationship with my attorney. I pa y for most of my work but since I refer a lot to him and I do pay for a lot of my services, I'd be able to e-mail him this question and he'd answer with no appt. nor fee. If you are going to be in business, my best piece of advice is to have an attorney who knows you, knows the general state your business, your general financial status, your goals, etc. Then, when you need help, he can step right in... kind of your own personal corporate counsel.
