The lease had gone MTM when the BF was arrested. The son was over 18 and a new lease was signed with him and the mother on it. The verbage stated that a security deposit had already been accepted when the mom and BF moved in. But other than that, nothing else was explicit.

You messed up. If the lease was month-to-month, then the right thing to do was draw up a new lease with the mother and adult son - you did this correctly.
Where you messed up was that the original lease ENDED, and all previous tenants are entitled to their security deposit - including the man who went to jail.
There is *no* forfeiture of a security deposit just because someone went to jail. Going to jail doesn't absolve the tenant of his responsibilities under the contract, nor does it absolve the landlord of his responsibilities under the contract or his responsibility to handle security deposits in accordance with state law.
